Cancellation & Refund Policy

1. Introduction

At Canada Wide Immigration, we are committed to professional transparency, ethical conduct, and compliance with the regulations of the College of Immigration and Citizenship Consultants (CICC). This Cancellation and Refund Policy outlines the terms governing cancellations, rescheduling, and refunds for both Initial Consultations and Full Retainer-Based Representation Services.

2. Initial Consultation Bookings (Paid Appointments)

2.1 Rescheduling Policy

  • Notice Period: Clients may reschedule a confirmed consultation without penalty by providing written notice via email at least 24 hours prior to the scheduled appointment.
  • A consultation may be rescheduled up to two (2) times. Further requests may be treated as a cancellation.

2.2 Consultation Cancellation & Refunds

  • 48+ Hours Notice: Cancellations made at least 48 hours in advance are eligible for a full refund, minus standard third-party payment gateway fees (typically 3%–5% credit card/Stripe processing fee).
  • 24 to 48 Hours Notice: Cancellations made between 24 and 48 hours prior are eligible for a 50% refund or a 100% credit toward a rescheduled session.
  • Under 24 Hours Notice & No-Shows:
    • Cancellations made with less than 24 hours’ notice are non-refundable.
    • If a client fails to attend a scheduled in-person or virtual consultation within 15 minutes of the start time (“No-Show”), the appointment is forfeited and the fee is 100% non-refundable. This compensates for the consultant’s reserved legal time.
  • Completed Consultations: Once a consultation has commenced or concluded, the fee is considered fully earned and non-refundable.

3. Retainer Agreements (Full Representation Services)

For clients retaining Canada Wide Immigration for comprehensive application handling (Express Entry, AAIP/PNP, Study Permits, Work Permits, Family Sponsorship, Citizenship, etc.):

3.1 Client Trust Account Handling (CICC Mandated)

In accordance with CICC regulations, all retainer funds paid in advance are held safely in a designated Client Trust Account. Funds are only transferred to the firm’s operating account as earned fees as specific milestones (defined in your written Retainer Agreement) are reached.

3.2 Client Termination of Services

You may terminate your Retainer Agreement at any time by providing written notice. Upon receiving your written notice:

  1. We calculate all professional work completed up to the termination date based on the hourly rate or milestone schedule stated in your signed agreement.
  2. Any direct disbursements or out-of-pocket expenses incurred on your behalf (e.g., couriers, translations) will be deducted.
  3. Any remaining unearned balance in your Client Trust Account will be refunded to you within 30 business days, accompanied by a detailed closing Statement of Account.

4. Non-Refundable Scenarios

Under no circumstances will refunds be issued for the following:

4.1 Government Refusals & Application Outcomes

  • Under Canadian law and CICC rules, no consultant can guarantee visa approval or processing times.
  • Professional fees are billed for our legal knowledge, preparation, document auditing, and official advocacy — not for the final decision of the immigration officer.
  • If an application is refused, returned, or delayed by Immigration, Refugees and Citizenship Canada (IRCC) or provincial authorities, professional fees paid to Canada Wide Immigration are strictly non-refundable.

4.2 Government & Third-Party Fees

  • All government fees paid directly to the Government of Canada (IRCC application fees, biometric fees, Right of Permanent Residence Fees [RPRF], AAIP provincial fees, LMIA processing fees) are strictly non-refundable once submitted to the government.
  • Third-party costs (including language tests like IELTS/CELPIP, medical exams, police certificates, and ECA reports like WES) are paid to outside bodies and are entirely non-refundable.

4.3 Client Fraud or Misrepresentation

If a client provides forged, altered, or fraudulent documents, or deliberately conceals prior visa refusals, criminal records, or medical inadmissibility, Canada Wide Immigration reserves the right to terminate representation immediately. In such cases, all fees are forfeited and non-refundable.

4.4 Changes in Canadian Immigration Law

We are not liable for, nor do we issue refunds for, changes in Canadian federal or provincial immigration policies, ministerial instructions, sudden quota caps, or Express Entry CRS cut-off score changes announced by IRCC after your services have commenced.

5. Refund Method & Processing

  • Method: Approved refunds are processed strictly back to the original payment method used during the transaction (credit card, wire transfer, or Interac e-Transfer). Cash refunds are not issued.
  • Currency: All transactions and refunds are issued in Canadian Dollars (CAD). We are not responsible for foreign exchange fluctuations or bank conversion charges.
  • Timeline: Consultation refunds are typically processed within 7 to 10 business days. Retainer trust balance reconciliations are completed within 30 business days.
